Course objectives supported by learning outcomes
The aim of the course is to provide students with a comprehensive overview of substantive and procedural civil law, with particular emphasis on the position and liability of court experts. The first objective is to acquaint students with the concept, subject, and system of civil law, including the structure of the Civil Code and its relationship to other branches of law. Emphasis is placed on the fundamental principles of substantive civil law, especially the principle expressed in § 5 of Act No. 89/2012 Coll., the Civil Code. Another objective is to explain the nature of civil-law relations, their participants (natural persons and legal entities), the importance of legal acts and representation, as well as the role of legal facts in civil law. The course also addresses family and inheritance law, in particular the legal regulation of marriage, registered partnership, cohabitation and their relation to property, as well as the regulation of inheritance and succession. A key part of the course focuses on the liability of court experts under the Civil Code and under Act No. 254/2019 Coll., on experts, expert offices, and expert institutes. This is followed by an introduction to civil procedural law, its sources, and the fundamental principles of civil proceedings. Special attention is devoted to the position and role of experts in civil proceedings, including the issue of evidence by expert opinion under the Code of Civil Procedure and its differences from the professional regulation under the Act on Experts. The final part of the course is dedicated to the analysis of real court cases related to the activities of court experts, thereby linking theoretical preparation with practical application.
Learning outcomes
Upon successful completion of the course, the student understands the fundamental institutes of substantive and procedural civil law, including their connection to expert law.
