Criminal procedural law

The aim of the course is to acquaint students with legislation and status procedural law in the system of law, definition of the procedure of subjects in criminal matters procedural relations, in particular the activities of law enforcement authorities in detecting criminal offenses, identifying their perpetrators and deciding on them, as well as the procedure for enforcing these decisions.

To teach students skills in the interpretation and application of individual provisions of the Criminal Procedure Code focusing on the status of criminal law procedural in criminal proceedings, scope of the Criminal Procedure Code, basic principles of criminal proceedings, subjects of criminal proceedings, procedural acts, decisions in criminal matters proceedings, securing of persons and things important for criminal proceedings, evidence in criminal proceedings, the course of proceedings, the procedure before the commencement of criminal prosecution,preparatory proceedings, supervision of the public prosecutor, court proceedings.

Evidence (Criminal Code and forensic methods of evidence)

Part of the course is to acquaint students with the issues of the subject and system of criminology, criminological characteristics and learning about crime, ways of their committing, criminological methods finding and securing evidence, types and significance of traces, general methodologies of criminalistic practice.

Students will get acquainted with the theoretical foundations of forensic technology, criminalistic tactics and criminalistic methodologies, the application of which in practice enables effective clarification and investigation of individual criminal offenses events in accordance with the principles of the Criminal Procedure Code and criminal proceedings.
Learning outcomes
Upon successful completion of the course, the student:

He applies the acquired knowledge of criminal law. Distinguish between the various stages of criminal proceedings, the status and rights of entities in the various stages of criminal proceedings. Describes, including an explanation of the individual forensic-technical and forensic tactical methods of detecting and securing clues and evidence. Explain the basic position of witness, expert, victim, victim, accused, accused and convicted. Distinguish, including the determination of appeals against decisions of the authorities active in criminal proceedings in its various stages. It will determine the possibilities of clarifying the proof of individual crimes and decisions on the level of criminality in willful and negligent conduct. Understand the differences in the procedural position of entities, participants and parties criminal proceedings and their rights under the Criminal Procedure Code.

  • 1. Introduction to criminal procedural law - the concept of criminal procedure, criminal proceedings, system of criminal procedure, basic principles of criminal proceedings and their importance.
  • 2. Subjects of criminal proceedings, position meaning.
  • 3. Definition of the parties, the position of the accused, witness, injured party, victim and their rights, the importance of instruction, attachment of claims, damages, damage, unjust enrichment, unjustified property benefit in criminal proceedings.
  • 4. Procedural acts - before the commencement of criminal proceedings, after the commencement criminal proceedings and at the end of them.
  • 5. Criminal proceedings and their course, initiation, clarification, termination of the case, adjournment of the case, suspension of criminal proceedings (prosecution).
  • 6. Securing persons and things important for criminal proceedings.
  • 7. Evidence, possibilities and direction, activity and position of bodies active in criminal proceedings; Expert evidence.
  • 8. The concept, subject and system of criminology.
  • 9. Ways of committing crimes.
  • 10. Criminalistic footprint.
  • 11. Forensic methods of identification of persons and things.
  • 12. Criminalistic-tactical methods of detecting and proving TC.
  • 13. Interrogation, reconstruction, recognition, investigation experiment and others forensic-tactical methods important for criminal proceedings.

To successfully complete the course, it is necessary to achieve a sum of continuous and final evaluation of at least 70% under the conditions set out below. 30 points, ie 30%, can be obtained in the continuous evaluation. Attendance at classes in all forms is solved by a separate internal standard of VŠTE (Records of student attendance at VŠTE). Students with an individual study plan will take only a 100-point final test from the NZ_TPP course in the examination period. However, students are required to contact the teacher immediately upon approval of the individual study plan (ISP); if the student does not do so, his or her ISP will not be considered.
