VŠTE-IS/2200/2026/215963 DECISION The Rector of the Institute of Technology and Business in České Budějovice, as the competent authority pursuant to Section 10(1) of Act No. 111/1998 Coll., on Higher Education Institutions and on Amendments and Supplements to Other Acts, as amended (hereinafter referred to as the "Higher Education Act"), has decided in the case of the applicant Alwin Simon, born on 3 August 1994, permanent addressKalathode p o,OUukkara, Thrissur, Kerala, India 680655, as follows: The request for an exemption from the Study and Examination Rules of the Institute of Technology and Business in České Budějovice is rejected. Statement of Reasons: The applicant submitted a request for an exemption from the Study and Examination Rules of the Institute of Technology and Business in České Budějovice via the VŠTE Information System on 28 July 2025. In the request, he stated the following: „Due to some family issues I didn't able to complete my studies within the time frame. And now I would like to continue my studies and need to finish my state exam.So I request you to approve the same." Pursuant to Section 56(1) b) of the Higher Education Act, the studies shall be terminated if the student fails to meet the requirements arising from their degree programme as set out in the Study and Examination Rules. The date of termination of studies is the date specified by the Study and Examination Rules. According to Section 68(1) g) of the Higher Education Act, the higher education institution shall decide on the student's rights and obligations in matters of failure to meet the requirements under Section 56(1) b). Pursuant to Section 68(5), the appellate administrative authority is the Rector, who reviews the circumstances of the failure in accordance with applicable legislation and the internal regulations of the higher education institution. Article 28(1) of the Study and Examination Rules of the VŠTE further stipulates that the Rector is authorised to grant an exemption from the provisions of the Rules in duly justified cases. The decision-making process in such cases is governed by Section 68 of the Higher Education Act. The Rector then considered the reasons stated in the application and found that the student does not have justified grounds on the basis of which an exemption from the Study and Examination Rules of the Institute of Technology and Business in České Budějovice could be granted. In view of the above, the Rector of the Institute of Technology and Business in České Budějovice rejected the request for an exemption from the Study and Examination Rules.
